Police: Alleged Assault Victim Pretended To Be Dead

(ABC 6 News) - Four men are in custody after a shooting in Rochester early Sunday morning.

Rochester Police were called to the Perkin’s restaurant on South Broadway just after 2:30 a.m. for a report of a fight in the parking lot.

However, police say several shots were fired before officers could get there. They found a bloody Armando Rodriquez in the parking lot.

They say Rodriguez claimed he was assaulted and then fired at several times and that he laid down in the parking lot, pretending to be dead, in order to avoid being hit.

Officers were eventually located the suspects' vehicle near the 1200 block of 6th Avenue S.E. in which they say they could easily see live rounds of ammunition. 

They say the alleged shooter, Carlos Rivera Jr., was arrested along with Diego Giron and another 16-year-old Rochester boy.

A semi-automatic handgun was recovered in a nearby yard.

Police say 6 to 10 shots were fired... some of them hitting buildings on the other side of South Broadway.

However, no one was hit and no serious injuries were reported.

Rivera is facing felony assault charges, reckless discharge of a firearm, and 2nd degree riot charges. All three suspects are facing felony 2nd degree riot charges.
