The city's Environment Planning Commission told KOB Eyewitness News 4 that Wal-Mart filed an appeal at 4:20 p.m. Friday of the Environmental Planning Commission's October vote against a proposed West Side store.
The commission will have two weeks to write up a report as to why its ruling should stand and send it to council, who will then assign the issue to a special Land Use Hearing Officer.
The officer is charged with looking at the full record and sending the council a report that either affirms or rejects the reason the commission gave for the denial.
The council will then vote to either accept or reject that decision.
New testimony on the issue will not be heard.
We're told any decision by the council won't likely occur until next year.
Wal-Mart has until 5:00 p.m. Friday to appeal the decision.
