The family of a man shot and killed by an Albuquerque Police officer is suing the department.

Stephen Torres, the father of 27 year-old Christopher Torres, is suing the department in federal court for damages on behalf of his son.

Christopher Torres was shot and killed by an officer in April last year. Police said they were trying to arrest Torres when he became violent, and that's when Det. Christopher Brown shot him.

According to the complaint filed by Torres, he alleges the department discriminated against his son because he suffered from a disability such as mental illness. Torres suffered from schizophrenia.

He also alleges the department used excessive force on his son.

According to the document, Christopher Torres' parents allegedly informed the department on more than one occasion that their son had a mental illness and should be contacted by specially trained crisis intervention officers if contact by the police was necessary.
