The CEO of Virgin Galactic says the future of Spaceport America could be decided in this legislative session.

George Whitesides told KOB Eyewitness News 4 if lawmakers don't pass a liability waiver his company could move to another state to do business.

A waiver would protect suppliers and manufacturers from lawsuits from space tourists if there are problems.

The state has already spent $200 million to build a spaceport near Truth of Consequences.

Whitesides said if the state legislature passes the liability waiver he guarantees space tourists will soon be launching out of New Mexico probably in about a year.
