Jury selection is underway Monday in a wrongful death lawsuit filed against the Albuquerque Police Department.
It concerns the death of Iraq War veteran Kenneth Ellis back in 2010.
Two weeks ago we told you that a district judge ruled that APD’s shooting of Ellis was "not justified."
Judge Sharon Bacon said an objectively reasonable officer would not have fired.
Officer Brett Lampiris-Tremba killed Ellis outside a Northeast Heights convenience store.
The Albuquerque city attorney has said that, before firing, officer Lampiris-Tremba reasonably perceived an imminent threat of deadly harm from Ellis, who was holding a gun to his own head.
The officer was cleared of wrongdoing by both APD internal affairs and a grand jury.
