Charges have been refiled against a rio grande high school wrestler accused of bullying.
State wrestling champion Nicholas Chavez is accused of slapping and taking money from a fellow student earlier this year.
He had a hearing Thursday, but the deputy who handled the case wasn't there and neither was the victim.
KOB Eyewitness News 4 is told the deputy never received a subpoena to appear in court so the Bernalillo County Sheriff's Office refiled the charges.
It's not know yet when the new court date will be.
