LAS CRUCES, N.M. (AP) - Las Cruces police say a 24-year-old woman walked into a hospital in the southern New Mexico city and surrendered her newborn daughter, saying she didn't want the baby.

Police say the woman acted legally in relinquishing custody under New Mexico's law providing safe havens for infants.

That law permits a person to leave an infant with hospital staff without being subject to criminal prosecution for abandonment or abuse as long as the infant is younger than 90 days and has not been mistreated or harmed.

Police say the woman went to the hospital Thursday morning. Police subsequently learned that she gave birth Wednesday evening.

Police spokesman Dan Trujillo says the hospital is caring for the infant who will be placed in the custody of the state Children, Youth and Families Department.
