The baby died in 2007 when Robert Flores left her in a laundry basket while he went to buy beer in Las Cruces. Flores was sentenced to 18 years in prison for negligent child abuse resulting in death and tampering with evidence.

Prosecutors filed an emergency motion in hopes the judge will reconsider.
