New Mexico Attorney General Gary King said he didn't find out about what was happening in Dona Ana County until Wednesday morning.
King said his office does not have the authority over county clerks.
"We don't intend at this point to take any action against the county clerk in Dona Ana County. We feel like our position that the law is unconstitutional presents a barrier to us from bringing action in that suit," King said.
King's office has said before that it is unwise for county clerks to issue licenses since state law is unclear about same-sex marriages.
