Rio Arriba deputy under investigation for assault with deadly weapon

KOB Eyewitness News 4 has confirmed a Rio Arriba sheriff's deputy is under investigation after a bizarre road rage incident in Santa Fe.

It happened on Christmas Eve, and the story is developing on Monday.

The Santa Fe Sheriff's Office says a Rio Arriba sheriff's deputy was somehow involved in a road rage altercation with some folks in another car on Christmas Eve.

"Our officers did respond to an assault with a deadly weapon call," said Santa Fe Sheriff Cpt. Adan Mendoza.

It happened at the intersection of St. Francis and Alameda on Christmas Eve around 5 p.m.

Some people say a silver Jeep flew past them at a stoplight. They caught up to the driver and confronted him, and that's when they told law enforcement things got out of control.

"The driver showed them a badge," said Mendoza. "Also brandished a weapon toward them."

The driver Mendoza is talking about turned out to be a Rio Arriba County sheriff's deputy. The badge was his own.

"That was later confirmed by the investigating deputy," said Mendoza.

Now the deputy is under investigation, and may face charges of assault with a deadly weapon.

"The Rio Arriba Sheriff's office was informed of the allegations," said Mendoza.

The sheriff's office in Rio Arriba is staying quiet. A spokesman refused to comment Monday on the allegations. 

Back in Santa Fe, Captain Mendoza says if they're true, one thing is clear.

"That behavior is not befitting of an officer," said Mendoza.

The deputy's name is not being released by either agency pending formal charges. The decision to file formal assault with a deadly weapon charges is up to Santa Fe District Attorney Spence Pacheco.

She tells KOB the details of the case have been delivered to her office and she is considering whether to file those charges.
