New Ulm Man Argues Banning Medical Marijuana is 'Unconstitutional'

The medical marijuana debate is heating up – this time in court.

Jon Hansen II of New Ulm will face a judge Tuesday to defend himself against charges of selling marijuana. Hansen argues that banning medical marijuana is unconstitutional.

Hansen is expected to argue that the government lacks the power to ban marijuana and that Americans have a "right to a healthy lifestyle." He says the government's classification of marijuana as lacking any medical use is "irrational" and "not supported by evidence."

Last week, a bill legalizing medical marijuana in Minnesota stalled over concerns from law enforcement. Gov. Mark Dayton has said he won't sign a bill that isn't supported by law enforcement. However, last week after meeting with supporters he called on legislators to see if a compromise can be reached.

Hansen's hearing is at the Brown County Courthouse.
