A Duluth business has filed suit against the City of Duluth and one of its neighboring businesses.
City Attorney Gunnar Johnson notified the city council of the lawsuit in an email Friday afternoon. He said the city had been served with a summons and complaint from Last Chance of Duluth, Inc., which has filed suit against the city and Whole Foods Community Co-op, Inc.
Johnson said the suit alleges the backup of water into the Last Chance Liquor Store building during the floods last June 20 was the result of negligence by the city and Whole Foods Co-op. The complaint alleges the city and the co-op are liable for damages in excess of $50,000.
The city has twenty days to answer the complaint.
