QUEENSBURY, N.Y. (AP) - An appeals court has reversed the conviction of a Warren County dance instructor on charges he sexually abused a young student, saying there were technical errors during jury selection.

The Appellate Division panel ruled Thursday the trial judge didn't properly question a potential juror about a possible bias against homosexuals and mishandled a juror's question about what would happen if there wasn't a unanimous verdict.

Warren County District Attorney Kate Hogan tells NewsChannel 13's media partners at the  Post-Star  she'll go ahead with plans to try 51-year-old Timothy McGuire again on charges he abused the boy.

During his first trial, McGuire denied having sexual contact with the boy.

McGuire was sentenced to five years in prison after being convicted last year of sexual conduct against a child and sexual abuse.
