NY whitewater outfitter acquitted at trial

ALBANY, N.Y. (AP) - A Hamilton County jury has acquitted a whitewater outfitter of reckless endangerment for sending a father and daughter down the Indian River in the southern Adirondacks without a guide.
Court officials say another misdemeanor charge from 2010 against Patrick Cunningham, owner of Hudson River Rafting, was dismissed earlier.
The inexperienced whitewater kayakers quickly fell out of the two-person boat and were rescued by guides from other rafting companies.
Cunningham's lawyer argued that the kayakers knew the risks and chose to go.
Cunningham faces other reckless endangerment charges from an incident last spring and a suit by the state attorney general seeking to shut his business after a client drowned last September after falling out of a raft with a guide who admitted being drunk.
