ALBANY – Robert Wimbush Senior lost his namesake Friday.  His son, 35-year-old Robert Wimbush Jr., was found dead outside a Green Street apartment complex in Albany's South End.

"He didn't deserve to die the way it happened," explained a grieving Wimbush Sr.

But exactly how it happened is under investigation still.  The Wimbush family claims police told them it was suicide.  But many members of the family have a different theory.

"I think it was murder. Someone pushed him," said Wimbush outside the family home, also in the South End.

According to Wimbush, his son's car was still running, parked next to the building that was the scene of the accident -- or crime -- when police arrived Friday just before 10 a.m.  Investigators, however, could not confirm that detail.

Also according to relatives, a few days prior, the 35-year-old has his SUV windows smashed out.  Family members believe it was done by someone affiliated with his ex-girlfriend.

"We're hoping someone saw something or heard something and we can get to the bottom of this," said Wimbush's stepsister, Jennifer Edwards of Colonie.

NewsChannel 13 also learned that Robert Winbush Jr. was a Level 3 sex offender, convicted in 2007.  Since then he has served time in prison and, according to relatives, just started up a car service business.

Making plans for his future, cousin Latoya Wimbush adds, is not the behavior of someone preparing to kill himself.

"Just the things he did previous to his death, a person committing suicide wouldn't do that.  I don't believe it...he had too much going for himself," she said.

Albany Police Department's spokesman reiterated today that they have not ruled this case a suicide and if anyone has any information to please contact detectives at 518-462-8039.
