SARATOGA SPRINGS, N.Y. (AP) - An upstate New York man has admitted slashing another man during a cookout, an attack witnesses originally said involved a 3-foot machete.
Saratoga County District James A. Murphy III says 46-year-old Russell Duffney Jr. of Saratoga Springs pleaded guilty Monday to second-degree assault. He's expected to be sentenced to three years in prison.
He says Duffney was originally charged with first-degree assault and criminal possession of a weapon because of the machete report and officers' initial belief an injury to the victim's ear was worse than it turned out to be. Murphy says a machete was never found at the scene and the only object resembling various descriptions of the weapon was a 36-inch piece of paneling found nearby.
The attack was on April 9 in Saratoga Springs.
