SCHENECTADY - One of two brothers shot at a backyard barbeque in Schenectady on Friday night has now died, leaving city detectives with their first homicide investigation of the year.

Police say 24-year old Jose "Mikey" Torres died at Albany Medical Center on Saturday after being shot in the torso the night before. His older brother, 31-year old Luis Gomez was also shot in the upper back. He's expected to recover.

"From the details that we got from witnesses, the perpetrator approached the backyard area where the party was taking place and began to open fire," said Schenectady Police spokesman Sergeant Adriel Linyear.

Linyear says more than two dozen people, including many young children, were in the backyard at 1633 Becker Street, when the gunman entered after dark, around 9:30 P.M. Friday.

"I don't believe it was a random act," Linyear said. "At this time we believe there was one shooter."

Evidence technicians were still at the scene late Saturday afternoon as mourners continued to gather around a curb side memorial for Torres.

As of 9:00 P.M> Saturday night, police say they have no one in custody.
