Assembly Speaker Sheldon Silver will have to wait a while longer to find out whether a lawsuit against him goes forward.
Today in court an attorney for Silver was trying to get the suit thrown out.
Citizen activist Robert Schulz filed the action for Silver's role in a once confidential sexual harassment settlement.
The lawsuit is fallout from the firestorm that appeared to put Silver's speakership in jeopardy last spring.
Silver's attorney is defending the Speaker's actions as part of his official duties, even though Silver quickly apologized and promised not to do it again.
Judge O’Connor reserved decision on dismissing the Schulz lawsuit.
She did not announce a day when her ruling will be released.
If the lawsuit is not dismissed, then the action claiming Speaker Silver exceeded his authority would go forward.
