QUEENSBURY - Testimony concluded Tuesday morning in the trial of the Glens Falls man accused of killing his 15-month old son.
Gary Waite's attorney called just one witness, the defendant's sister, before resting his case.
Waite did not take the stand.
Police investigators testified the 30-year-old told them he threw his son because he wouldn't stop crying.
The child died a couple days later at Albany Med.
Waite is not charged with intentional murder, but rather depraved indifference murder, accusing him of recklessly causing the child's death.
