New York’s SAFE Act does not violate the second amendment and was not pushed through improperly.

That's was Wednesday's ruling from state Supreme Court Justice Thomas McNamara.

The case was brought by citizen activist Robert Schulz of Queensbury.

He claims the Safe Act in itself, is a violation of New Yorkers’ rights.

He also takes issue with the speed with which the bill was passed.

McNamara ruled that Schulz failed to make his case.

Schulz now plans to appeal to the state's highest court.
